Terms and Conditions – Commercial Bay Fork & Fame Awards 2025

1. These are the terms and conditions ("Terms") for the Fork & Fame promotion at Harbour Eats in Commercial Bay ("Promotion") run by Precinct Properties Holdings Limited (“Precinct”).

2. By entering the Promotion, you agree to these Terms.

What is the Promotion?

3. Commercial Bay is giving away the chance to WIN lunch for a year at Commercial Bay, to the value of $5000.

4. The Promotion offers anyone who votes for the People's Choice Award in the Fork & Fame Awards at Commercial Bay the opportunity to win a $5000 Commercial Bay Voucher. Entries are made by:

(a) Scan a QR in Commercial Bay or visit https://www.commercialbay.co.nz/forkandfame during the promotion period (between June 30th - July 31st).

(b) Place your vote for the People’s Choice Award, selecting your preferred Harbour Eat’s vendor, and entering your preferred dish from the selected vendor.

(c) There is no limit to the number of entries for a singular person.

5. The Promotion is available from and including 30th June - 31st July 2025 ("Promotion Period"). 

6. The winner of the Promotion can win at any point during the Promotion Period.

7. The winner of the Promotion will receive a $5000 Commercial Bay gift card (“Prize”), which can be redeemed at participating retailers.

8. There can only be one winner of the “Prize”.

How do you win?

8. Entrants to the Promotion must provide accurate and up to date information as requested by Precinct from time to time.  By entering the Promotion, each entrant warrants that all information submitted by them is true, complete, accurate and does not infringe any other party's rights. Any information provided to Precinct will be used in accordance with Precinct's Privacy Policy, which is available online at  www.precinct.co.nz and www.commercialbay.co.nz.

9. The winner’s biographical details and photographs and audiovisual recordings of them may be used for publicity purposes in all media by Precinct, and they agree to make themselves available for this purpose.

10. By submitting a vote for the People’s Choice Award as part of the Fork & Fame promotion, you agree to be entered into the prize draw to win a $5000 Commercial Bay voucher. By entering, you also consent to be subscribed to Commercial Bay’s marketing database and may receive promotional emails, updates, and news related to events, offers, and experiences at Commercial Bay. You can unsubscribe at any time via the link provided in our emails.

11. The Prize must be redeemed by the winner within 12 months of the end of the Promotion Period. If the Prize is not redeemed within this period, then the Prize shall be forfeited and shall not be capable of being redeemed by the winner. 

12. The Prize cannot be redeemed for cash.

Additional terms for the Promotion

13. In the event of a dispute regarding the Terms, or any aspect of or relating to the Promotion, the decision of Precinct shall be final and binding and no correspondence or discussion shall be entered into.

14. Promotion entries must be made in the manner specified by Precinct. Failure to do so may disqualify the entry.

15. Employees of Precinct or any other owner of any part of Commercial Bay, or any company involved in the Promotion or members of their families or households, are not eligible to enter the Promotion. Precinct reserves the right to verify the eligibility of the winner and any entrant.

16. Precinct reserves the right to disqualify any entrant on reasonable grounds or to refuse to award the Prize to an entrant that Precinct decides (in its sole discretion) has violated the Terms, gained unfair advantage in participating in the Promotion or won using improper, unfair or fraudulent means.

17. In the event that any entrant is disqualified from the Promotion, Precinct in its sole discretion may decide whether a replacement entrant shall be selected. In this event, any further entrant will be selected on the same criteria as the original entrant and will be subject to these Terms.

18. Except with the prior written consent of Precinct, the Prize is non-transferable, is not redeemable for cash and the total value of the Prize is limited to the stated value of the Prize. Precinct reserves the right to substitute prizes of equal or greater value at any time.

19. The winner takes the Prize entirely at their own risk and, to the maximum extent permitted by law, Precinct will not be liable to the winner in respect of any claim for any loss, damage or injury whatsoever (including, without limitation, any consequential, indirect, special, punitive or incidental damages) or for any physical or mental injury suffered by the winner or family member or friend as a result of or in connection with the Terms, Promotion or by reason of the utilisation or application of the Prize.

20. The entrant releases Precinct, their directors, managers, staff and agents from and disclaims all claims, whether in contract or tort or otherwise in respect of or arising from the Terms, Promotion or Prize to the maximum extent permitted by law.  If a court of competent jurisdiction holds Precinct, its directors, managers, staff or their agents or employees liable in respect of any matters arising under or incidental to this Promotion, then the total aggregate liability shall be limited to $5,000.

21. Precinct reserves the right in its sole discretion to cancel, terminate, modify or suspend the Promotion or Prize. Precinct is not liable to any entrant or winner for any loss or damage as a result. 

22. The Terms are governed by the laws of New Zealand and any dispute arising out of or in connection with them will be subject to the exclusive jurisdiction of the New Zealand courts.

23. The promoter is Precinct Properties Holdings Limited.
